When your marriage breaks down and there is no prospect of reconciliation, the Divorce procedure can be stressful, uncertain and scary. You may have the following questions:
Common Questions About Divorce in Ontario
- What are the steps required to go through a Divorce?
- Who will my child(ren) reside with?
- Do I need to hire a lawyer?
- What is going to happen to the house that I live in with my spouse?
- How long does a Divorce take from start to finish?
The first thing to remember is that YOU are the most important priority! You must protect your physical, mental and emotional health while going through a Divorce. It is natural for you to feel overwhelmed when confronted with issues such as paying child support, negotiating to get more parenting time with your child(ren), and decision-making responsibilities.
Second, you must consider what NOT to do during a Divorce to minimize the number of errors you make. Depending on the number of years that you and your spouse were married and the type of marriage breakdown (e.g. high conflict), this dramatic change in your daily life can be mentally exhausting.
It is important for you to engage in “reality checks” by ensuring that you do NOT do the following:
Six Things NOT to Do During a Divorce
- Leave the matrimonial home/residence that you have been living with your husband or wife because that could result in your spouse changing the locks and claiming exclusive possession.
- Post negative things about your spouse on social media, including TikTok, Facebook, etc. as the posts could be used as evidence against you within the Divorce proceedings. It’s also important to remember that you must communicate with your spouse in the future so be polite.
- If you have children, say negative or derogatory things about your spouse in the presence of the child(ren) because that can cause the child to develop mental health issues. Equally important is you should not “weaponize” the child(ren) by manipulating them to dislike the other spouse while adoring you.
- Spread your confidential information relating to Divorce among family and friends. The reality is that people gossip and it’s important to restrict the people with whom you share confidential information to a few trusted friends and/or family members.
- Engage in self-denial if you experience the early signs of lingering sadness or depression. It may be necessary to contact a counsellor, minister or other trusted professional to share what you’re going through.
- Ignore the fact that a lawyer can assist you with your Divorce by providing valuable information about the divorce process, how to deal with core issues such as parenting time (access) with children, decision-making responsibility, division of assets and debts such as the matrimonial home, pension. Knowledge is power!
